We represent FBI executives, managers, and employees in OPR investigations, OARM cases, EEO matters, FBI Early Retirement cases, and reinstatement cases.

OPR Referrals, IA/IIS investigations & OIG Investigations

  • Recently, the FBI has increased the tempo of investigations against employees and junior managers.  Most disturbingly, the FBI will terminate employees for false statements based on an interview.  The employee will not be given a chance to explain the issue or be given a polygraph.  OPR and HRD just terminate the employee.  Anytime, an FBI employee is the subject of an internal investigation, there is the possibility the employee will be fired. 
  • OIG can investigate FBI employees for criminal as well as administrative misconduct.  If you volunteer to talk with an OIG investigator, you may be setting yourself up for termination or being charged with a federal crime.  One of the most common charges is 18 U.S.C 1001.  Many times, you have the right to remain silent.  Other times, remaining silent will get you fired or cause you to lose your security clearance.


FBI Whistleblower Cases/Retaliation/ OARM Cases

  • FBI employees have fewer employment rights than many other federal agencies.  FBI employees do not have the right to go to federal court with a whistleblower right.  Going to the press will get you fired and possibly arrested.  The exclusive method FBI agents have to report misconduct is by filing an OIG complaint about retaliation and requesting corrective action from the DOJ's Office of Attorney Recruitment and Management (OARM).  An FBI employee has less than of 3% chance of winning an OARM case because the cases are complex and the FBI always plays hardball.
  • Statistically, doing an OARM case without an attorney is virtually impossible to win.
  • However, FBI employees have been charged hundreds of thousands of dollars in attorneys fees to be represented in OARM.  One tool the FBI has is to drive employees into bankruptcy through prolonged litigation.  We work with FBI employees to ensure they can be effectively represented without paying unreasonable and sometimes unnecessary legal fees.
